Alameda County Probate, Estate Planning & Business Attorney
Sargent Law Offices is a probate, estate planning and business law firm located in Alameda County. Our goal is to become our clients’ trusted partner. We know that planning for one’s own death, or becoming the executor, administrator or trustee after a family member has died, is very stressful. We seek to de-mystify the process so that our clients are empowered to make informed decisions for themselves and their families. As a boutique law firm, we are able to spend the extra time with our clientele, and delight in helping them plan for their future.
Estate Planning is vital to ensuring that your wishes are followed, not only after you die, but should you lose capacity. In California there are five hundred and eighty thousand (580,000) people with Alzheimer’s in 2014, that number is projected to jump to eight hundred and forty thousand (840,000) by 2025. Planning is essential to ensure that you are cared for, in the manner of your choosing, prior to death. We can assist you in all the facets of estate planning, including creating: a will, revocable trust, irrevocable trust, durable power of attorney, advanced healthcare directive, guardianship, conservatorship, tax planning, and amending your trust and related documents.
Probate and Trust Administration are different sides of the same coin. Probate is the court-supervised distribution of a person’s estate after they die. Trust administration is the private administration of an estate. Each require that the executor or trustee notify the heirs and beneficiaries, notify state and federal agencies, collect assets, pay creditors and ultimately distribute the estate to the person(s) named in the document or determined by intestate succession. The executor or trustee is responsible for managing the assets, paying taxes and closing the estate. We are here to ensure that the executor and trustee perform all of the necessary tasks under the law in order to distribute the estate with minimal problems. We provide personalized guidance to help you navigate difficult situations which may arise.
Business Formation is the first step to letting your customers, and the government, know that you are in business. Proper formation can prevent a myriad of tax, liability and litigation issues down the road for your company. We assist clients with C-Corp, S-Corp, Limited Liability Corporation (LLCs), Limited Liability Partnerships (LLPs), Professional Corporations, Partnerships, Incorporation Documents, Bylaws, Buy-Sell Agreements, Non-profit formation and Succession Planning.
